Libera circolazione dei dati con privacy by design

Lo scopo del regolamento europeo passato oggi al Parlamento sulla protezione dei dati – General Data Protection Regulation (GDPR) – e nato quattro anni fa è di aumentare la certezza del diritto in Europa nella privacy, garantendo i cittadini, le aziende e le autorità di pubblica sicurezza che la normativa cerca di ottenere il migliore equilibrio tra i vari interessi.

Viviane Reding, MEP and former vice-president of the European commission who proposed the changes in 2012, said: “This is a historic day for Europe. This reform will restore trust in digital services today, thereby reigniting the engine for growth tomorrow.

“There can be no freedom without security, and no security without freedom. Today’s concomitant adoption of these three legislations sends a strong signal that national security and data protection can and must go hand in hand.” (Guardian)

Il regolamento è fatto di maggiori sanzioni per le aziende che non rispettano la privacy (europee, americane o altro), maggiore facilità per le polizie europee nello scambiarsi i dati, maggiore uniformità di regole tra i paesi in modo che i dati possano circolare più facilmente tra le economie europee. Il regolamento va in vigore subito, anche se ci saranno aggiustamenti nei paesi. E dopo l’impatto iniziale cominceremo a valutare i dettagli. Ma sarebbe interessante vedere se con questo quadro normativo saranno incentivate le nuove piattaforme che nascono con privacy by design: una base eccezionale per sostenere in modo corretto la nascita di una concorrenza europea alle piattaforme affermate americane.

Nel frattempo il Parlamento ha approvato anche la creazione di nuovi grandi database di informazioni personali su chi viaggia in Europa.
